Minimum wage#
The Arkansas minimum wage is $11.00 per hour, effective January 1, 2021. Issue 5 (2018 ballot initiative) finished phasing in at $11.00 on 1/1/2021; no increases scheduled and no indexing. Applies to employers with four or more employees (Ark. Code §11-4-203).
Preemption Arkansas preempts local minimum wage ordinances — cities and counties cannot set their own general wage floors.
Tipped employees & tip pooling#
Arkansas allows a tip credit: employers may pay tipped employees a cash wage of $2.63 and claim up to $8.37 per hour in tips toward the minimum wage. Employee must customarily and regularly receive tips; employer bears the burden of proving tips bring total compensation to at least $11.00/hour and must keep tip records. Ark. Code §11-4-212. The $2.63 cash minimum has been fixed for decades while the credit grew with the state minimum wage.
Tip pooling#
No state pooling statute beyond the tip-credit rules; federal standards apply (no employers/managers/supervisors; tip-credit pools limited to customarily tipped staff). (29 C.F.R. §531.54)

Overtime#
Overtime is due after 40 hours in a workweek. State overtime at time-and-a-half after 40 hours (Ark. Code §11-4-211), paralleling the FLSA.

- Wage statements: No comprehensive private-sector pay-stub statute; Arkansas Department of Labor and Licensing rules require payroll and tip records sufficient to substantiate the tip credit — flagged: no specific statement statute to cite.
- Exempt salary floor: $684.00/week (federal) — No state EAP salary floor; federal $684/week applies (DOL's 2024 increase was vacated and DOL reverted).
- Lodging credit: Reasonable value of board, lodging, or other facilities customarily furnished may be counted toward the minimum wage per state labor rules, paralleling FLSA §3(m); requires accurate cost records.
Act 643 of 2017 preempts local minimum wages, so the $11.00 state rate is uniform statewide. With the cash tipped wage frozen at $2.63, tip-credit compliance (records, makeup pay in slow weeks) is the main hotel F&B exposure.
