Minimum wage#
The Mississippi minimum wage is $7.25 per hour, effective July 24, 2009. Mississippi has NO state minimum wage law; the federal FLSA $7.25 applies to covered hotel employers. Rate shown is the federal minimum.
Preemption Mississippi preempts local minimum wage ordinances — cities and counties cannot set their own general wage floors.
Tipped employees & tip pooling#
Mississippi allows a tip credit: employers may pay tipped employees a cash wage of $2.13 and claim up to $5.12 per hour in tips toward the minimum wage. Federal FLSA rules: more than $30/month in tips, advance notice of the tip credit, and cash wage plus tips at least $7.25. No state tipped-wage law; federal $2.13/$5.12 applies.
Tip pooling#
No state statute; federal FLSA rules apply — no employer/manager/supervisor retention of tips; mandatory traditional pools permitted when a tip credit is taken. (29 U.S.C. 203(m))

- Pay frequency: Miss. Code 71-1-35 requires biweekly/semimonthly paydays only for manufacturers and certain public employers (50+ employees); hotels are generally not covered, so frequency is a matter of policy.

- Exempt salary floor: $684.00/week (federal)
- Lodging credit: Federal FLSA section 3(m) reasonable-cost credit applies; no separate state rule.
Miss. Code 17-1-51 prohibits local governments from setting minimum wage or other employment mandates — relevant to the Gulf Coast casino-hotel corridor, where the FLSA is effectively the only wage-hour law.
