Minimum wage#

The Oklahoma minimum wage is $7.25 per hour, effective July 24, 2009. State rate tracks the federal minimum (40 O.S. §197.2). State Question 832 (a proposed $15 phased minimum with indexing) is slated for a June 2026 statewide vote — monitor the outcome. The state act's own coverage is limited (10+ FTE at one location or $100,000+ gross sales, non-FLSA employers), but FLSA covers virtually all hotels.

Preemption Oklahoma preempts local minimum wage ordinances — cities and counties cannot set their own general wage floors.

Tipped employees & tip pooling#

Oklahoma allows a tip credit: employers may pay tipped employees a cash wage of $2.13 and claim up to $5.12 per hour in tips toward the minimum wage. Tips plus cash wage must equal $7.25; federal notice and 80/20 duties limits apply to FLSA-covered hotels. A 2025 amendment to the state minimum wage act (effective Nov. 1, 2025) aligned Oklahoma's tip-credit structure with federal law, allowing a cash wage of $2.13. Before that, the state act capped the credit at 50% of minimum wage ($3.63 cash) for state-covered employers, though FLSA-covered employers already used $2.13. Lodging/meal credits interact with the tip credit under the state act — review combinations carefully.

Tip pooling#

No state pooling statute; FLSA governs — valid pools among tipped staff, managers/supervisors excluded, BOH only when no tip credit is taken. (29 U.S.C. §203(m)(2)(B))

Overtime#

Overtime is due after 40 hours in a workweek. No state overtime statute for private employers; FLSA 1.5× over 40 applies.

Meal breaks: Not required by Oklahoma law for adult employees. Federal law requires only that breaks under 20 minutes, if offered, be paid.

Pay administration#

  • Pay frequency: At least SEMIMONTHLY on regular designated paydays for most private-sector employees; exempt/managerial and certain employers may pay monthly (40 O.S. §165.2).
  • Wage statements: Itemized statement of deductions must accompany each wage payment (Oklahoma Protection of Labor Act). (40 O.S. §165.2)
  • Exempt salary floor: $684.00/week (federal) — Federal $684/week applies.
  • Lodging credit: The state act permits counting the fair value of board/lodging furnished toward the minimum wage; FLSA §3(m) standards apply to FLSA-covered hotels.

Local minimum wages and mandated employee benefits are preempted by 2014 legislation (SB 1023), passed amid an Oklahoma City wage campaign. Watch SQ 832 (June 2026 vote): if approved, a phased state increase with CPI indexing would supersede the $7.25 floor and sharply raise tipped-wage exposure for hotel F&B.
